1) What we are (and aren't)

2) Eligibility

You must be able to form a binding contract in your jurisdiction (generally 18+). If you apply for a grant, you confirm the application content is yours or properly licensed.

3) Wallets, chains & smart contracts

You are solely responsible for your wallet(s), private keys, seed phrases, and on-chain activity. Transactions are irreversible and may incur network fees. We do not custody assets and cannot recover lost funds.

4) User content & license

If you submit or upload content (e.g., applications, artworks, text, images, handles), you grant REALART a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and display that content in connection with the Services (including featuring winners and documenting grants). You remain the owner of your work.

5) Grants & public receipts

Grant selections are made at our discretion with community input. All payouts and relevant details (amounts, dates, tx hashes) may be published on-chain and on the Site for transparency.

6) Brand use & UGC

Community use of our brand assets for memes or UGC is generally permitted with reasonable credit and without implying endorsement, sponsorship, or affiliation. We may update brand guidelines at any time.

7) Prohibited use

You agree not to use the Services to:

• break laws or infringe IP/privacy rights;
• upload unlawful, misleading, or harmful content;
• engage in fraud, market manipulation, spam, or phishing;
• attempt to interfere with the Site's security or availability.

8) Third-party services

Links, DEXs, explorers, forms, or tools referenced on the Site are third-party services. We do not control or endorse them and are not responsible for their content, security, or policies.

9) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALART AND ITS TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

11) Indemnity

You agree to defend, indemnify, and hold harmless REALART from any claims, damages, liabilities, costs, and expenses arising from your use of the Services or violation of these Terms.

12) IP concerns (notice & takedown)

If you believe your copyright or other rights are infringed, contact legal@realart.site with: (a) identification of the work; (b) the allegedly infringing material/URL; (c) your contact info; (d) a good-faith statement.

13) Changes

We may modify these Terms at any time. Updated Terms are effective upon posting with the "Last updated" date. Continued use means you accept the changes.

14) Governing law & venue

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Courts located in Los Angeles County, California shall have exclusive jurisdiction.
